With Finality! SC: Architects Sole Signatories for Architectural Designs

Manila, Philippines – Senior Associate Justice Marvic Leonen penned a decision in which the high court’s Second Division resolved the conflicting provisions of Republic Act No. 544, also known as the Civil Engineering Law, and RA 9266, also known as the Architecture Act of 2002. This decision clarifies that only licensed architects have the authority to sign and approve architectural documents, thereby promoting safety, quality, and adherence to building regulations within the rapidly growing construction industry.

Before the decision, the Philippine Institute of Civil Engineers, Inc. contended that civil engineers should be permitted to prepare, sign, and seal architectural documents in accordance with the National Building Code, Republic Act 544, and the Civil Engineering Law. Nonetheless, Republic Act No. 9266’s Section 20, paragraph 5 makes it clear that  “all architectural plans, designs, specifications, drawings, and documents relative to the construction of a building shall bear the seal and signature only of a registered and licensed architect.

As required, the government limits the signing ability to licensed architects in order to:

  • Enhance public safety: Minimize the risk of structural failures and ensure the safety of building occupants and the surrounding community.
  • Maintain high construction standards: Promote the use of best practices and innovative techniques in the design and construction process.
  • Ensure qualified professionals carry out construction projects to safeguard the rights and interests of building owners and the general public.
